Content Policy for Print Reproductions & Image Services

Agreement
Customer enters the following agreement for print and/or image services upon submission of digital image files to Private Press. Customer affirms that they hold the copyright and permission of any identifiable persons photographed or depicted within the submitted images and that all shared content adheres to applicable laws and regulations. Customer agrees to full legal responsibility for this and all identifiable persons or depictions of any persons. Private Press reserves the right to deny service to any Customer believed to be in violation of applicable laws and regulations. Private Press reserves the right to immediately destroy digital image files depicting content believed to be in violation of applicable laws and regulations. 

 

Any Identifiable Persons
Customer holds all liability to ensure that any persons depicted in submitted digital images fully consent to any provided print and/or image services. Any persons depicted in Customer submitted digital images may withdraw their consent to print and/or image services at any time.
 
No Underage Persons
Underage Persons to be defined as no person under the age of 18 years old. Under no circumstances shall a Customer submit a digital image file that includes Child Sexual Abuse Material here defined as CSAM, including: a minor, either partially or fully exposed, engaged in sexually suggestive content or not; any real or realistic image of what appears to be an actual minor, whether it is sexualized or not; anything that might be considered sexualization of minors in any artistic interpretation or fantasy setting including underage cartoon characters, CGI renders, or AI generated images; minors that appear in the background of an image or images, e.g. those that include a picture on the wall that includes a minor, etc. Private Press reserves the right to immediately destroy any such Customer submitted digital image file.
 
No Animal Cruelty
Under no circumstances shall a Customer submit a digital image file depicting the real or fantasy harm of any type of animal, either dead or alive, in any sexual or non-sexual context. Such depictions include any real or suggested content of sex acts with animals, known as bestiality. Animals include, but are not limited to mammals, insects, and fish. Private Press reserves the right to immediately destroy any such Customer submitted digital image file.
 
Registered Sex Offender
Any Customer who is a Registered Sex Offender (RSO) convicted of a violent or nonconsensual sexual offense is not permitted to submit images for any service. Any persons known to be RSO will be denied service. Private Press reserves the right to immediately destroy digital image files submitted by such Customers.
 
Copyright
Customer must hold full copyright permission for all submitted digital image files. Private Press reserves the right to immediately destroy any Customer submitted digital image file for which the Customer does not hold full copyright permission.
 
Customer holds full copyright permission when they have the “Intellectual Property” rights to an image. This can be because: 

1.  Customer owns the copyright to the content, e.g. Customer created original work;

2.  Copyright owner has given the Customer permission to reproduce the work digitally or in print;

3.  Content is in the public domain;

4.  Content has a Creative Commons license or similar; or

5.  Submitted image content falls under “fair use” by meeting ALL of the following factors:

          • purpose and character of work,
          • nature of work,
          • amount of work used compared to copyrighted work, and
          • effect of use on potential market for work.

 
File Storage and Privacy
Customer agrees to submit digital images to Private Press by providing a download link to digital image files ordered for print and image services. Customer holds full liability for the security of the download link and original hosting of the digital image files. Private Press agrees to store all downloaded customer digital image files on a secured physical drive. Private Press agrees not to store customer digital image files on any cloud-based internet host or any online data storage host.
 
File Retention
Private Press will store Customer submitted digital image files until the completion of ordered products or services and will delete all project files after 7 days. Customer images will always be stored on a physical hard drive and will never be stored on any online or cloud-based image host service. Customer understands that after the 7 day period any reprints or additional services would require a new image file. Private Press can hold digital image files beyond the seven day grace period at Customer request upon specific agreement between parties that intend to order additional products or services with the images.
 
Receiving and Submitting Image Files
Customer will need to supply Private Press with a secure download link to any images for use in print or image services. Customer is responsible for the security of the download link and hosting platform. Private Press will supply any customer images via a secure download link and will make every effort to ensure that the link is secure.
